The internal regulations version November 2023. Association for Model Aviation Sports v.z.w. This regulation of internal order is an addition to the statutes of the association which were approved by the General Assembly and published in the appendices of the Belgian State Gazette. CHAPTER I: REGARDING THE MEMBERS 1. The effective members in personal title and the effective members of the board. 2. The effective member clubs. 3. The admitted members. 4. CHAPTER IV: CODE OF ETHICS. 1. The operation of the association will always be carried out in accordance with the applicable decrees for the recognition and subsidization of sports federations, the decree of the non-professional athlete of July 24, 1996, the decree on healthy and ethical sports of December 20, 2013, the Anti-Doping Decree of May 25, 2012, and the applicable implementing decisions of these decrees. The statutes and the internal regulations contain no provisions that prevent the promotion of general sports practice by the population. 2. The association accepts the principles and rules of democracy, endorses the European Convention on Human Rights and the International Convention on the Rights of the Child. 3. The association will take all measures to combat human trafficking within the vzw and among the affiliated members by implementing existing legislation and will also act sanctioning in cases of abuse based on an ethical code to combat human trafficking. 4. Legal residence for persons without Belgian nationality. The inclusion of athletes who do not have Belgian nationality without an employment contract cannot be refused due to an illegal residence status. This is contrary to the non-discrimination principle and for minors with the international children’s rights convention. To avoid competition distortion, proof of identity may be requested by the federation in certain sports. If the athlete has no identity card, the sports club informs the person about the identity under which they are registered at school if it concerns a minor, or may request a certificate from the municipality from the athlete. Within the V.M.L., this identity check can be requested when participating in national championships and when selecting candidates for and participants in European and world championships. 5. The medically responsible sports practice. The V.M.L. will follow the Flemish legislation regarding medically responsible sports practice. All effective member clubs are required to comply with the decree of March 27, 1991, including its later amendments regarding medically responsible sports practice. If they do not comply, they will be automatically excluded. The V.M.L. will strictly adhere to the decree regarding the prevention and combating of doping in sports. In case of any violation, the Board will take steps automatically, which may result in exclusion. 6. The principles and rules of democracy. The V.M.L. will follow the principles of democracy. All effective member clubs are required to follow the same rules of democracy. If they do not comply, they will be automatically excluded. The VML will comply with the decree regarding the prevention and combating of doping. 7. The European Convention on Human Rights. The V.M.L. will follow the European Convention on Human Rights. All effective clubs are required to respect the same rights. If they do not comply, they will be automatically excluded. 8. The international convention on the rights of the child. The V.M.L. will follow the international convention on the rights of the child. All effective member clubs are required to follow the same international convention. If they do not comply, they will be automatically excluded. 9. Disciplinary procedures regarding doping practices. For disciplinary procedures regarding doping practices committed by elite athletes, the Flemish Cluster of Air Sports vzw, of which the Association for Model Aviation Sports vzw is a part, has signed a mandate agreement with the vzw Flemish Doping Tribunal, which establishes a joint disciplinary body, namely the Disciplinary Commission for Elite Athletes, for organizing disciplinary procedures regarding doping practices committed by elite athletes who fall under the responsibility of the Association for Model Aviation Sports vzw, in accordance with the MVS decree of July 13, 2007. 10. Integrity Contact Point (API). An integrity contact point is an easily accessible contact point where athletes, their parents, guardians or other involved parties can go with a question, suspicion or complaint about (sexual) inappropriate behavior or physical or sexual integrity. An integrity contact person (API) ensures that the policy gives sufficient attention to the prevention of and dealing with (sexual) inappropriate behavior. This means that even outside of incidents, reflection takes place on existing practices, that possible risk factors are mapped out and that initiatives are taken for a healthier and safer sports climate. The integrity contact person is elected from among the members. 11. General Data Protection Regulation (GDPR). By becoming a member of the VML, you agree to our privacy statement, as stated in the “privacy statement” published on our website. The VML will always comply with the applicable laws and regulations, including the General Data Protection Regulation (GDPR) as stated on the website. The personal data of members, as well as the personal data of persons entrusted with an administrative or sports function, will only be used to ensure the functioning of the association. The data will never be forwarded, without consent, to a third party for commercial purposes. The VML does everything possible to handle this data with the necessary caution and in a responsible and secure manner. 12. Portrait rights. The portrait right is a special limitation of copyright and arises from the privacy law. It gives portrayed persons, under certain conditions, the right to object to the publication of their portrait. The photographer has the copyright on the photo he/she took of a person but may not publish this photo in all cases. Before a photo of someone is taken, consent is requested and it is explained for what purpose this photo or photos will be used. Anyone who violates portrait rights by publishing photos without consent that violate the privacy of the portrayed individual may be held liable to pay damages.
