US ITC Issues Final Determination on PVDF Resin in Section 337
According to the China Trade Remedy Information Network, on December 9, the United States International Trade Commission (ITC) announced that it has made a partial final determination on certain Polyvinylidene Fluoride Resins (investigation code: 337-TA-1439) under section 337: it decided not to review the initial determination (No.19) made by the administrative law judge on November 18, 2025. This determination was based on the applicant's request to rename Solvay Specialty Polymers, USA LLC to Syensqo Specialty Polymers, USA LLC, and Solvay Specialty Polymers Italy S.P.A to Syensqo Specialty Polymers Italy S.P.A.
On July 15, 2025, the United States International Trade Commission (ITC) issued a final ruling: it will not review the initial ruling made by the administrative law judge on June 23, 2025 (No. 9), thus adding U.S. registered patent numbers 8337725, claims 8 and 9 to the investigation against the named defendants Zhejiang Fluorine Chemical New Material Co. Ltd., Shaoxing, China and Hubei Fluorine New Materials Co., Ltd., Qianjiang, China based on the supplemental request filed by the applicant.
On April 22, 2025, the United States International Trade Commission (ITC) issued a final determination: it decided not to review the initial determination (No.8) made by the administrative law judge on April 1, 2025. Based on the settlement, the investigation against the named respondent, Inner Mongolia 3F Wanhao Fluorochemical Industry Co. Ltd., Fengzhen, China, was terminated.
On February 14, 2025, the U.S. International Trade Commission (ITC) voted to initiate a Section 337 investigation regarding certain polyvinylidene fluoride resins (Investigation No. 337-TA-1439).
On January 13, 2025, Synesqo SA of Belgium, Solvay Specialty Polymers, USA LLC of Alpharetta, Georgia, USA, and Solvay Specialty Polymers Italy S.P.A. of Italy filed a Section 337 investigation application with the US ITC. They claimed that the export to the US, import into the US, and sales in the US of the said product violated Section 337 of the US Tariff Act (infringement of US Patent No. 8337725) and requested the US ITC to issue a limited exclusion order and a cease-and-desist order.
