China's First! China Initiates Anti-circumvention Investigation on Related Optical Fiber Products from the U.S.

On March 4th, the Ministry of Commerce issued an announcement to initiate an anti-circumvention investigation on certain U.S. fiber optic products, marking the first such investigation launched in our country.

It is understood that the relevant U.S. fiber optic products are suspected of circumventing China's anti-dumping measures. At the request of domestic industries, the Ministry of Commerce has lawfully initiated the country's first anti-circumvention investigation. Based on the results of the investigation, a decision will be made on whether to impose anti-circumvention measures against the U.S.

An anti-circumvention investigation targets behaviors that evade current anti-dumping or countervailing measures. This type of investigation is widely used by many WTO members to ensure the effectiveness of trade remedy measures.

Evidence submitted by the applicant shows that U.S. exporters may have circumvented China's anti-dumping measures on non-dispersion-shifted single-mode optical fiber products from the U.S. by exporting related cut-off wavelength shifted single-mode optical fibers to China.

After receiving the application, the investigating authority reviewed it according to the law and found that the application met the conditions for initiating an anti-circumvention investigation, thus deciding to launch the investigation.

The investigating authority will conduct the investigation in accordance with the law, fully ensuring the rights of all interested parties, and make a fair and impartial ruling based on the investigation results.
