Final Ruling Victory! OLED Patent 337 Investigation Results Announced BOE Upholds Fair Competition in Global Display Industry
On March 19, U.S. time, the U.S. International Trade Commission (ITC) officially announced the final ruling of the Section 337 investigation on OLED patents initiated against Samsung Display from South Korea, upholding the preliminary ruling in early November 2024. The ITC administrative judge ruled that there was no violation of Section 337 of the Tariff Act of 1930 in this investigation. This victory effectively curbed the practice of using patent litigation to hinder the development of China's display industry, promoting a more fair and open competitive environment for the global display industry.
As a key participant in this investigation, BOE, the leading domestic display industry company, played a significant role during the process. In recent years, to maintain its global OLED market position, Samsung Display from South Korea applied for the initiation of a 337 investigation, intending to prompt the ITC to issue a general exclusion order, specifically aiming to prevent Chinese OLED products from entering the U.S. market. In February 2023, in response to the "general exclusion order" proposed by Samsung Display, BOE proactively applied to intervene in the investigation, maximizing the protection of the legitimate rights and interests of relevant parties in the OLED industry chain, providing strong support for winning the final ruling.
Industry insiders believe that Samsung is using its market position to leverage the 337 investigation as a means of suppression, attempting to reduce competition in the OLED market. This could potentially increase the cost for American consumers to access OLED screens, while also reducing the choices available to American brand manufacturers and harming their interests.
BOE's proactive involvement in the investigation and its victory not only demonstrates the increased influence of Chinese technology companies in the high-end manufacturing sector, highlighting the confidence and strength of China's display industry in global competition, but also maintains the normal trade order of the global OLED industry chain, providing a model for more Chinese technology companies to deal with international patent litigation disputes.
Industry experts point out that in the international market competition, the global display industry needs to abandon zero-sum game thinking and promote the universal benefit of innovative display technologies globally through positive interactions, injecting sustained momentum into the continuous innovation of the display industry.
